[23/01, 10:13] Sudhir Kumar Gupta: The Hon’ble Supreme Court, inter-alia, directed to make compliance of the RC Gupta’s case with 8 weeks which expired on 30.12.2022. Till 30.12.2022, the EPFO failed to make compliance for a single case across the country, and allow those retirees on the 20.01.2023 portal whose services retired before 01.09.2014 with the condition that few retirees may get a higher pension. Now, as per my observations :
1. First: the Circular dated 29.12.2022 is not at all confirm the concept of the RC Gupta case or the latest judgment dated 04.11.29022 of the Hon’ble Supreme Court.
2: Second: as directed by the Hon’ble Supreme Court, the compliance of the RC Gupta’s case was not done deliberately by the EPFO within the period of 8 weeks
3. Third: For existing employees who want to exercise their higher pension option, and 4 months time was granted to the existing employees, neither such option was developed on the portal nor physically such option is being accepted or allowed.
4. Fourth: Purpose fighting cases before the Supreme Court and its directions in favor of retirees is going to be defeated.
I hope in these circumstances, non-compliance attracts the contempt of the court’s order.

Those who fail to submit options online, please submit offline, Format A, B, and C, as applicable, forthwith to the concerned RPFC/APFC as well as to the CPFC, Delhi to avoid further entitlement of higher pension.
*Criteria for getting a higher pension* If your Employer deducted the EPF from your actual salary without adhering ceiling limit of Rs.5000 or Rs.6500, are entitled Higher pension. Kindly see the circular dated 19.
